1. Scope of Application

This document contains the General Conditions of use of the site corresponding to the domain name www.pelletteriacharlotte.it owned by Stores Marchetti Srl (hereinafter, respectively, the “ Conditions ” and the “ Site ”) which regulate the sales relationships between the company Marchetti Srl, with registered office in 25087 Salò (BS) – Via Campagnola, 52/B, VAT number and tax code 02671230981 (hereinafter referred to as “ Marchetti Srl ” or “ Seller ”) and all people who visit or make a purchase through the website http://www.pelletteriacharlotte.it (hereinafter referred to as the “ Customer ”).

The offer and sale of products on the website http://www.pelletteriacharlotte.it , are therefore governed exclusively by these conditions of sale, formulated in compliance with the legislation on distance selling and in particular articles 50 et seq. of the Consumer Code (Legislative Decree no. 206 of 6 September 2005 and subsequent amendments and additions). The Conditions may be subject to revisions or updates by Marchetti Srl at any time. unilaterally and at its sole discretion, also in light of any regulatory changes, without the need to notify the Customer. It is the latter's sole responsibility to periodically review the Conditions before accessing the contents of the Site. The Conditions are published on the homepage of the Site, via a specific link in the " Conditions of Sale " section.

Access to the Site, or any other action that involves browsing the Site itself, implies full knowledge of the contents of the Conditions by the Customer and, as a result, its acceptance. In addition to the above, anyone accessing the Site implicitly declares to be of age and not to use the Site and the material contained therein for illicit purposes or in any case contrary to the current laws.

2. Conclusion of the Contract

To conclude the purchase contract for one or more products, the customer must fill out the order form (hereinafter " Order ") in electronic format and send it to the seller electronically following the relevant instructions. The purchase contract for one or more products on the Site will be considered concluded between the customer and Marchetti when the Seller receives, electronically, the specific order form, after verifying the correctness of the data relating to it.

Once orders are transmitted to the system, they cannot be modified or blocked. It is the Customer's responsibility to ensure that they are correct before giving actual confirmation. With reference to orders placed through the Site, within the terms set out in art. 51 paragraph 7 of Legislative Decree 206/2005, an email confirming the order just placed will be sent to the Customer's email address.

In the Order, which will be displayed immediately before the conclusion of the purchase contract, all summary information will be provided relating to the essential characteristics of each product ordered, to these Conditions and to the Privacy policy. By sending the Order, the Customer expressly accepts and undertakes to unconditionally observe all that is foreseen and regulated by these Conditions, by Privacy policy and from the additional information contained on the Site. The order form will be stored in the Seller's database for the period of time necessary to process the orders and, in any case, for a period not exceeding that required by law. The Seller may refuse purchase orders received that do not provide sufficient guarantees of solvency or that are incomplete or incorrect or in the event of unavailability of the products.

In these cases, Marchetti will inform the Customer by email, promptly and in any case within thirty (30) days from the day following the day on which the Customer sent his order to the Seller, that the contract has not been concluded and that the Order has been refused, indicating the reasons. In the event of forwarding of the Order and simultaneous payment of the price, the Seller will refund, without delay, any amount already paid by the Customer. Upon acceptance of his order, the Customer will receive by email the order confirmation and confirmation of payment in which all the information required relating to the obligations undertaken will be indicated: information about the products ordered, the amount paid, the return methods, information on assistance services as well as the Conditions of Sale and the privacy policy. The Customer also declares that he acknowledges that the product he purchases is intended exclusively for the country in which he places the order; therefore, in the event that the Customer introduces the product into a different country, he will be held exclusively responsible for the introduction and, as a result, will be required to follow the regulations and restrictions applicable both for export from the country in which he purchased the item and for import into the country in which the product was introduced.

3. Products Sold

The products offered for sale by Marchetti They are of excellent quality and value and all the necessary checks have been carried out on them.
The essential characteristics of the products are presented on http://www.pelletteriacharlotte.it within each product sheet. The images and colours of the products offered for sale on the Site may however not correspond to the real ones due to the Internet browser and monitor used by the Customer.

The price of the product published on the Site is for a single item, expressed in Euros and inclusive of VAT. Marchetti will take charge of paying all taxes, duties, charges (and/or shipping costs for an order with a value equal to or greater than €100.00). The prices published on the Site may be subject to updates and promotions at the discretion of the Seller. The Customer is obliged to verify the final sale price before submitting the relevant Order.

4. Payment

To pay the price of the products and the related shipping and delivery costs, the Customer must follow the methods indicated in the order form. In no case will costs be charged that are higher than those actually incurred by the Seller, in relation to the payment instrument chosen by the Customer.

Payment by the Customer can be made exclusively by credit card or active account PayPal or Shopify Payments . The following credit cards are accepted:

– Visa/Visa Electron ;
– Mastercard ;
– PostePay
– American Express

The total amount of the order is blocked on the credit card or account PayPal of the Customer at the time of forwarding the order to Marchetti , with simultaneous acceptance by Marchetti and activation of the preparation of products for shipping. In case of payment by credit card, the financial information (for example, the credit/debit card number or its expiration date) will be forwarded, via encrypted protocol, to Nexi Payments Spa, supplier of the related remote electronic payment services, without third parties being able to access them in any way.

Furthermore, such information will never be used by the Seller, except to complete the procedures relating to the Customer's purchase and to issue the relevant refunds in the event of any returns of the products, following the exercise of the right of withdrawal, or if it becomes necessary to prevent or report to the Police the commission of fraud on http://www.pelletteriacharlotte.it .

The Customer will receive the sales invoice at the address indicated by him if requested at the time of placing the order.

5. Shipping and Delivery

All Customer orders will be delivered to the shipping address specified when placing the order. Items in an order may be shipped to the customer from different warehouses. Shipping costs will be applied only once. The Customer accepts that the Seller may deliver the goods in a smaller quantity (in terms of number of items or models) than indicated in the Order and in such an eventuality the Customer accepts that, except in cases of willful misconduct or gross negligence by the Seller, the only remedy granted to him consists in the non-debiting of the goods subject to non-delivery (or in the reimbursement in the event of a debit having occurred) without the possibility for the Customer to refuse delivery, to terminate the relationship or to request compensation for any damages. Partial shipments are permitted as long as they are within the confirmed delivery limit. The delivery of the products is carried out in Italy, for orders with a total of products less than €100.00, shipping is €10.00. For orders that reach or exceed €100.00, delivery is free. In Europe, shipping remains at €10.00 for orders under €150.00, and free for orders over that amount. For our customers in Turkey, we maintain a shipping rate of €10.00. Finally, shipments to the United States and England have a fixed cost of €30.00, to the address indicated by the Customer.

The Customer will receive an email from the Seller informing of the start of the delivery process with an indication of the acceptance of the shipment by the Courier. Once the goods have been accepted by the Carrier, communications regarding the delivery will take place exclusively between the Customer and the courier.

The date for delivery of the goods will be considered indicative but not binding for Marchetti . From the notification of acceptance by the appointed Courier, 3 to 5 days will be necessary for deliveries on the peninsula, up to 7 days for deliveries on islands or remote areas, except in cases of force majeure. Delivery has a cost of € 10.00 for all orders with a product subtotal of less than € 100.00. Delivery is free for all orders with a product subtotal equal to or greater than € 100.00. The Customer, once the goods have been received in the appropriate box with the Charlotte logo, must verify that the white labels with the Charlotte logo have not been tampered with. Failing this, and in the event that the box has been tampered with before delivery, the Customer is required not to collect the package and to promptly notify us by email by filling out the form in the "Contacts" section of the Site.

6. Discount Coupon

The Discount Coupon is occasionally offered by Marchetti . In some cases the Discount Coupon is issued in the form of an alphanumeric promotional code to be entered on the order summary page. In other cases it will be automatically applied to the first available order.
Discount codes can be conveyed in different ways including:

– Via Email as part of Direct Marketing Campaigns
– Social Marketing Campaigns

The amount of the Discount Coupon will be subtracted from the total amount of the order and will be displayed on the order summary page.
A Discount Coupon cannot be used to pay shipping costs for an order.
The amount and expiry date of the Discount Coupon as well as the conditions of use will always be clearly indicated in the same way in which the alphanumeric code is communicated.

Discount codes must be used within the expiration date. After this date, the Discount Coupon can no longer be used and the holder cannot request a replacement with another code with a longer validity.

The Discount Coupon can be used exclusively on the Site and cannot be used in stores owned by Marchetti Srl Likewise, vouchers issued for returns at points of sale cannot be used for purchases made on the Site.
Gift cards issued at points of sale cannot be used for purchases made on the Site. The purchase of products using the Discount Coupon is in any case subject to the Terms and Conditions of Sale of the Site. Some promotions available on the Site may be subject to specific terms and conditions of use. The customer is invited to read them before making the purchase.

7. Content of the Site

Marchetti Srl intends to offer, through the pages of the Site, general information in relation to its activity and, although the latter are constantly verified and updated by competent and specially selected personnel, it is understood that the content of the same, with reference to the subject matter covered, must not be considered either exhaustive or complete or in any case correct. Therefore, the user who intends to rely on the information reported on the Site must carry out an independent and further verification of the correctness of the same.

In this regard, Marchetti Srl informs that the material contained in the Site is to be considered " on as is basis ", that is, it may not be adequate and/or suitable for specific purposes and interests pursued by the person accessing its pages or it may contain elements which, if reused, could determine violations of intellectual property rights owned by third parties.

The Site may contain links to third-party sites. In this case, hyperlinks have the sole function of facilitating user navigation without there being any relationship between the content of the Site and that of the third-party site reached, which remains outside the sphere of action of Marchetti.

8. Intellectual and Industrial Property Rights

All contents of the Site are protected and safeguarded by the current regulations on copyright and industrial and/or intellectual property. By way of example, but not limited to, the contents of the Site shall be understood to include, among other things:

– The Texts ;
– The Photographs
– The Films
– The Databases
– Graphs and Tables
– The Slogans
– Audio reproductions
– Animated drawings or not
– Any graphic and/or text representation in general

It is therefore not possible to copy and/or reproduce in whole or in part the contents of the Site without the express written authorization of Marchetti .

At the same time, it is noted that all trademarks, domain names, company names, firms and signs present on the Site are owned by third-party companies or by Marchetti and therefore protected by the current legislation on distinctive signs.

9. Features of the Service

Marchetti, while adopting all the most innovative and cutting-edge technological solutions to ensure that the Site is constantly accessible and free from defects of any kind, hereby informs that the Site may not be reachable and/or compatible with the computer systems used to access it, nor free from errors, viruses and/or other computer malfunctions.

10. Returns and Refunds

The Customer can always request the return of the purchased products within 14 days of receiving the goods, following the procedure indicated in the section “Returns and Refunds” on the Homepage of the Site.

Returns or size exchanges of online orders cannot be made in stores.

To request a return of a product, the Customer must write to shop@pelletteriacharlotte.it and send the return authorization request. With compliance with all the terms set out in these Conditions for returns, the latter will be confirmed and the Customer will receive an email from the Seller with the instructions for delivering the item to the Seller. These will also always be available in the " Returns and Refunds " section on the Homepage of the site.

From receipt of the return authorization email, the Customer has a further 14 days to deliver to the Seller the products that he has been authorized to return.
The return shipping costs will always be borne by the customer – unless otherwise communicated by the Seller – and will amount from € 10.00 up to a maximum of € 30.00. This amount will be deducted from the refund that the Seller will provide, within 14 days of receiving the item to be returned, in the event that the return is confirmed.

The right of withdrawal – in addition to compliance with the terms and conditions described in this article, is considered to be correctly exercised if the following conditions are also fully respected:

– The item has not been used or damaged during testing;
– The item has not been soiled or washed;
– The item retains all original charms, labels, tags and finishes;
– The article has not undergone any changes.

Products must be returned in their original packaging and boxes (e.g. shoe boxes or small accessories), with the original labels, wrapping and other accessories (bag etc.) received in the package – which must be considered as an integral part of the item itself.

The original product packaging must not, under any circumstances, be used as alternative packaging boxes for return shipments. In fact, the same box received from the Seller with delivery must be used, ensuring its closure by sealing the box with adhesive tape and following the specific instructions received together with the return authorization email and in the " Returns and Refunds " section on the Homepage of the Site.
As soon as the product for which the return has been requested is delivered to the Marchetti warehouse, the relevant Office will carry out the appropriate checks on the products. The customer will receive a communication via email with the outcome of the aforementioned checks.

The provision for crediting the amount due for all items received that satisfy the conditions set out in this article will be followed, minus the amount of €10.00 up to a maximum of €30.00, as a contribution to the return shipping costs, which will be borne by the Customer. The Seller will make the refund using the same payment method used to pay the price of the returned products. Shipping costs will not be refunded if paid at the time of ordering. If one or more items do not satisfy the checks, the Seller will communicate the negative outcome to the Customer.
Marchetti will ship, cash on delivery via an agreed courier, to the Customer's shipping address, the items deemed non-compliant. Shipping is to be considered at the Customer's expense.

In the event that the return is not accepted by Marchetti , and the consumer does not wish to take back the goods, a refund will be provided equal to the value of the item net of the decrease in value resulting from handling of the goods other than that necessary to establish the nature, characteristics and functioning of the goods. The responsibility for such decrease is attributable exclusively to the Customer.

11. Warranty

Products purchased through the Sales Channels are covered by a legal guarantee for Product defects and faults (the “Guarantee”).

Marchetti undertakes to deliver to the Customer Products that comply with the Contract. If the Products are found to be defective and/or not compliant with the promised quality, the Customer must – within the term of the Warranty – communicate to Marchetti , that he has become aware of the situation.

Unless proven otherwise, defects that appear within 24 months of the date of delivery of the Product are presumed to have already existed on that date, unless such presumption is incompatible with the nature of the goods or the defect.

The Warranty is valid for 2 years starting from the date of delivery of the Product.

If Marchetti finds that the Product is defective or non-compliant, the Customer will have the right to have the Product brought into conformity by requesting, free of charge, the repair or replacement of the Product, unless the requested remedy is objectively impossible or excessively onerous (taking into account the value of the goods and the extent of the defect). Marchetti will repair or replace the defective Product within a reasonable time.

Marchetti will bear the costs of returning the defective and/or non-compliant Products for repair or replacement pursuant to this clause, as well as the cost of delivering the repaired or replaced Product to the Customer.

The Customer acknowledges and accepts that any defects or damages which occur after the time of delivery of the goods, such as, for example, those caused by improper use by the Customer or third parties, are not covered by the Legal Guarantee.

Please remember that slight differences in grain and colour shades characterise the naturalness of the material.
