General Terms of Use and Sale

1. Scope of Application

This document sets out the General Terms of Use for the website www.pelletteriacharlotte.it (hereinafter, the “Terms” and the “Website”), which govern the sales relationships between Marchetti S.r.l., with registered office at 25080 Manerba del Garda (BS) – Via Campagnola 52/B, VAT no. and Tax ID 02671230981 (hereinafter, “Marchetti” or “Seller”), and all persons who visit or make a purchase through the Website (hereinafter, “Client”).

The offer and sale of products on the Website are governed exclusively by these Terms, formulated in compliance with regulations concerning distance selling (Legislative Decree 206/2005 and subsequent amendments).

The Terms may be updated or modified by Marchetti at any time, including due to regulatory changes, without prior notice. It is the Client's responsibility to consult them periodically.

Access to and browsing of the Website imply full knowledge and acceptance of the Terms. By accessing the Website, the Client also declares to be of legal age and not to use it for illicit purposes or purposes contrary to current law.

2. Conclusion of the Contract

To purchase one or more products, the Client must complete the order form (hereinafter "Order") in electronic format and transmit it electronically to the Seller, following the instructions on the Website.

The contract is considered concluded when Marchetti receives the Order and verifies its correctness. An order confirmation will be sent to the Client via e-mail within the legally required timeframe.

Transmitted orders cannot be modified or blocked; it is the Client's responsibility to verify their accuracy before confirmation.

The Seller may refuse incomplete, incorrect, unsolvable orders or in case of unavailability of products, informing the Client via e-mail and arranging for the refund of any amounts already paid.

3. Products Sold

The products offered for sale by Marchetti are of high quality and subjected to careful checks.
The essential characteristics of each product are described on the dedicated page on the Website. The images are for illustrative purposes and may differ from the actual products due to monitor or browser settings.

Prices are expressed in Euro, including VAT. Marchetti reserves the right to apply promotions or modify price lists.
For orders equal to or exceeding €150 in Italy and €200 in Europe, shipping costs are free.

4. Payment

Payment can be made exclusively by credit card, PayPal or Shopify Payments. The following cards are accepted:

  • Visa / Visa Electron

  • Mastercard

  • PostePay

  • American Express

Transactions take place via encrypted protocol (Nexi Payments Spa). Data is not accessible to third parties or stored by the Seller.

5. Shipping and Delivery

Orders are shipped to the address indicated by the Client. Items may originate from different warehouses, but shipping costs will be applied only once.

Partial deliveries are allowed, provided they are within the confirmed limits. In case of unavailability of part of the goods, the only remedy recognized to the Client is the non-charge or reimbursement of the relative amount.

Delivery times

  • Italy: 3-5 working days (up to 7 for islands and remote areas).

  • Europe: 4-6 working days.

  • Extra-EU countries: variable depending on destination and customs procedures.

Shipping costs

  • Italy: €10.00 for orders under €150.00. Free for orders equal to or above €150.00.

  • Europe: €10.00 for orders under €200.00. Free for orders equal to or above €200.00.

  • Extra-EU countries: costs vary depending on the destination and are calculated automatically at checkout.

For orders destined for countries outside the European Union, any customs duties, taxes, import duties, customs clearance charges and any other costs required by the customs authorities of the destination country are entirely borne by the Client and are not included in the product price or in the shipping costs indicated at the time of the order.

The amount of such charges may vary depending on the destination country, the value and type of goods, and is determined by the competent customs authorities or the courier responsible for delivery.

MARCHETTI SRL is not responsible for the determination, amount or payment of such charges. The Client is therefore required to inform themselves in advance about any applicable taxes, duties and fees for import into their country.

The Client will receive shipping confirmation via email. Once the package has been entrusted to the courier, any communications regarding delivery will take place directly between the Client and the courier.

Upon receipt, the Client must check that the package and the labels with the Charlotte logo have not been tampered with. Otherwise, they are required to not accept the package and to communicate this immediately via the form in the Contacts section of the Website.

6. Discount Voucher

Discount Vouchers are occasionally offered by Marchetti. In some cases, the Discount Voucher is issued as an alphanumeric promotional code to be entered on the order summary page. In other cases, it will be automatically applied to the first eligible order.
Discount codes may be conveyed through various channels including:

– Via E-mail as part of Direct Marketing Campaigns
– Social Marketing Campaigns

The amount related to the Discount Voucher will be deducted from the total order amount and will be displayed on the order summary page.
It is not possible to use a Discount Voucher to pay for shipping costs of an order.
The amount and expiration date of the Discount Voucher, as well as its conditions of use, will always be clearly indicated in the same way the alphanumeric code is communicated.

Discount codes must be used within their expiration date. Beyond this date, the Discount Voucher can no longer be used, and the holder cannot request a replacement with another code of longer validity.

The Discount Voucher is exclusively usable on the Website and cannot be used in Marchetti S.r.l. owned stores. Similarly, vouchers issued for returns at physical stores cannot be used for purchases made on the Website.
Gift cards issued at physical stores cannot be used for purchases made on the Website. The purchase of products using the Discount Voucher is still subject to the Website's Terms and Conditions of Sale. Some promotions available on the Website may be subject to particular terms and conditions of use. The customer is invited to review them before making a purchase.

7. Website Content

Marchetti S.r.l. intends to offer, through the pages of the Website, general information related to its activity and, although these are constantly verified and updated by competent and specially selected personnel, it is understood that their content, with reference to the subject matter, should not be considered exhaustive, complete, or otherwise correct. Therefore, users who intend to rely on the information presented on the Website must conduct an independent and further verification of its accuracy.

In this regard, Marchetti S.r.l. informs that the material contained on the Website is to be considered "on an as is basis", meaning it may not be adequate and/or suitable for specific purposes and interests pursued by the person accessing its pages, or it may contain elements which, if reused, could lead to violations of third-party intellectual property rights.

The Website may contain links to third-party websites. In such cases, the hyperlinks merely serve to facilitate user navigation without there being any relationship between the content of the Website and that of the third-party website reached, which remains outside Marchetti's scope of action.

8. Intellectual and Industrial Property Rights

All content on the Website is protected and governed by current copyright and industrial and/or intellectual property laws. By way of example, but not limited to, the content of the Website shall include:

– Photographs
– Videos
– Databases
– Graphics and Tables
– Slogans
– Audio reproductions
– Animated or non-animated drawings
– Any graphic and/or textual representation in general

It is therefore not possible to copy and/or reproduce in whole or in part the content of the Website without the express written authorization of Marchetti.

At the same time, please note that all trademarks, domain names, company names, business names and signs present on the Website are owned by third-party companies or by Marchetti and are therefore protected by current legislation on distinctive signs.

9. Service Features

Marchetti, while adopting all the most innovative and cutting-edge technological solutions to ensure that the Website is constantly accessible and free from defects of any kind, informs that the Website may not be reachable and/or compatible with the computer systems used to access it, nor free from errors, viruses, and/or further computer malfunctions.

10. Returns and Refunds

The Client can request a return within 14 days of receiving the goods, by sending an e-mail to shop@pelletteriacharlotte.it and awaiting authorization with the relevant instructions.

A return is valid only if the products are intact, unused, unwashed, and complete with tags, labels, packaging, and any original accessories.
The return shipping costs are borne by the Client, unless otherwise communicated by the Seller, and will be deducted from the refunded amount.

The refund will be processed within 14 days of receipt and verification of the products, using the same payment method used for the order.

In case of products not complying with the conditions, Marchetti will inform the Client and arrange for their return at the Client's expense.

11. Warranty

Products are covered by a 24-month legal warranty from delivery, for conformity defects already present at the origin.

The Client has the right to free repair or replacement, unless the request is impossible or excessively burdensome. Marchetti will bear the costs of returning and resending replaced or repaired products.

The warranty does not cover damages due to improper use or normal wear and tear.
Any differences in leather grain or color are natural characteristics of the material and do not constitute defects.
